Intellectual-property infringement notices
This procedure helps a rightsholder or duly authorized representative notify Studiume about material that may infringe copyright or another intellectual-property right. It does not limit court proceedings or any mandatory statutory procedure.
Submitting a notice
Email hello@studiume.com with the subject “IP notice”. State the claimant’s name, reply contact, status as rightsholder or representative and, for a representative, details of the authority to act.
Describe the protected subject matter and the basis of the claimed rights, provide available evidence and identify the disputed material precisely: a URL, learning-workspace, Course or Material name and other information sufficient to locate it without disclosing unrelated confidential information. Confirm that the notice is made in good faith and that the information supplied is accurate.
Where applicable law imposes a particular form, signature, representation requirement or other mandatory particulars, the notice must comply with those requirements.
Review and interim measures
Studiume reviews whether there is enough information to identify the material and claimed right, may request clarification and communicates the decision. Where a notice reasonably indicates an infringement risk, access to the specific material may be temporarily and proportionately restricted while the matter is reviewed.
Unless prohibited by law or likely to create additional risk, the user who added the material is informed of the notice and may explain the basis for use. Studiume may maintain the restriction, remove or restore the material in light of the information supplied, a binding request from a court or competent authority, and applicable law.
User response
A user may respond through hello@studiume.com, precisely identify the material and provide information about authorship, a licence, permission, a statutory exception or another basis for use. Knowingly false statements or documents may result in access restrictions and liability under applicable law.
Limits of Studiume’s role
Studiume does not undertake to generally monitor all user content and does not finally determine ownership of rights in place of a court. The operator complies with binding decisions of courts and competent authorities and may take urgent measures where material creates an obvious and substantial legal or security risk.
To handle a notice, Studiume processes contact information, evidence, correspondence and a limited decision log. This information is used only to assess the notice, protect rights, comply with law and handle a possible dispute under the Privacy Policy.
